Your application is NOT complete until you appear together in the Somerset County

Register of Wills Office with the required documents and fee listed below.

 

Before starting, please note these important GUIDELINES:  

 

1. Applicants must be 18 years of age or older to apply for a marriage license. Pennsylvania law no longer permits individuals under 18 years of age to apply for a marriage license.

 

2. DO NOT APPLY unless you are within 60 days of your wedding date. The marriage license is only valid for 60 calendar days once it is issued by the office.

 

3. PA Consolidated Statute Title 23 requires a three-day waiting period between the times the couple appears in the Somerset County Register of Wills Office to complete the application process until the license can be issued to the couple.

 

4. The marriage license may be used anywhere in the Commonwealth of Pennsylvania.

 

Requirements:

 

When you come into the Register of Wills Office, you MUST have the following:

 

1. A valid, government-issued Photo ID (State Driver's License, Passport, Military ID, etc.) or a government-issued birth certificate.

 

2. $60 Fee—check or money order ONLY accepted. 

 

3. If a divorce or death of a spouse from the most recent marriage has occurred before your application, you must present a certified copy of a divorce decree signed by a judge or a death certificate.

 

4. The Register of Wills office is located in the Somerset County County Courthouse at 111 East Union Street, Suite 145, Somerset, PA 15501.

 

5. The office is open Monday--Friday from 8:30 a.m. to 3:30 p.m. The office is closed on national holidays.

 

Instructions on completing the application online:

 

1. Turn off any web viewer pop-up Blockers before you start.

 

2. Answer ALL questions. If you do not know the answer to a question, enter "Unknown"

 

3. When you are ready to begin the application, click on the ACCEPT at the bottom of the screen. You can then begin to enter your information. You can also use the SAVE function to save the information and return it at a later time. When you are ready to submit the application to the county, use the SUBMIT function.

 

Marriage License Application Disclaimer:

 

Pennsylvania law requires officiants to be ordained by “a regularly established church or congregation.” This office will not determine what is/is not a church or congregation. Please be advised if you choose to be married by someone other than the officiants specifically listed and authorized by Pennsylvania law, the burden of proof regarding the legality or lack thereof of your marriage will be upon you should future issues arise that require a determination of the legality of the marriage.

 

To be recognized as legal by the Commonwealth of Pennsylvania, marriage must be performed under a valid marriage license duly issued by the Clerk of Orphans’ Court and must be officiated by one of the following individuals specifically recognized under PA law as authorized to officiate, to wit:

           

1503. Persons qualified to solemnize marriages.

 

(a) General rule, - The following are authorized to solemnize marriages between persons that produce a marriage license issued under this part:

 

  1. A justice, judge, or district justice of this Commonwealth.
  2. A former or retired justice, judge, or district justice of this Commonwealth who is serving as a senior judge or senior district justice as provided or prescribed by law.
  3. An active or senior judge or full-time magistrate of the District Courts of the United States for the Eastern, Middle, or Western Districts of Pennsylvania.
  4. An active or senior judge of the United States Court of Appeals for the Third Circuit who is a resident of this Commonwealth.
  5. A mayor of any city or borough of this Commonwealth
  6. A minister, priest, or rabbi of any regularly established church or congregation.

(b) Religious organizations – Every religious society, religious institution, or religious organization in this Commonwealth may join persons together in marriage when at least one of the persons is a member of the society, institution, or organization, according to the rules and customs of the society, institution, or organization. (Amish and Quakers if you are a member).

(c) Marriage license needed to officiate – No person or religious organization qualified to perform marriages shall officiate at a marriage ceremony without the parties having obtained a marriage license issued under this part.

Effective January 1, 2006, Common Law marriage is no longer valid in Pennsylvania.

Effective June 1997, blood tests are no longer required to apply for a marriage license.
